Lewes MP Norman Baker wants to call time on car clamping on private land, such as the area next to Waitrose in Lewes, where clamping on Sunday mornings has so infuriated local people.
Now the MP has tabled a Parliamentary motion calling for private car clamping to be banned. The motion, tabled last Thursday, has so far gained the support of 12 MPs, including 7 Lib Dems.
Mr Baker, also his party's Shadow Transport Secretary, tabled the motion following long-running problems with private clamping companies in the Lewes constituency, particularly in areas such as the car park next to Waitrose and Laura Ashley in Lewes. A recent government consultation, Licensing of wheel clamping businesses, failed to include the option of banning clamping on private land. (Note: this consultation closes on 23rd July 2009.)
Previous research conducted by the Lib Dems showed that some companies do not charge for their services but rely on clamping fees to make a profit. Some employees of such companies are receiving as much as £50 per vehicle commission. It is not clear whether the arrangements apply in the Lewes situation.
In Scotland, car clamping is illegal as it is considered "extortion", but it remains legal in England, even though motorists have no independent means of appeal against the actions of car clamping companies on private land.
Norman Baker commented:
"The clamping of vehicles on a Sunday morning in what look like public parking spaces in Lewes is a disgrace. Those vehicles are causing no problems and are being targeted simply because they are easy prey.
"It is absolutely wrong that there should be a financial incentive for private companies to clamp vehicles. Clamping must be properly regulated, and should only be carried out by publicly accountable bodies such as the police or local authorities.
"It is simply not right that a private company, who may have an incentive to place more clamps in order to make more money, should be able to demand large sums from motorists who may well be entirely innocent and who have no right of independent appeal. Many of my constituents, as well as others around the country, have been victims of these unfair practices for far too long.
"It is hugely disappointing that the government has failed to act on this outrageous practice, and I hope that my motion will help to draw attention to this important issue. The government should follow the example set in Scotland, recognise that this practice is nothing short of extortion, and outlaw it immediately."
